Terms of Service

These Terms of Service ("Terms") govern your use of Antiquer: Antique Identification & Appraisal ("Antiquer," "the App"), developed by Anton (Batumi, Georgia). By using Antiquer, you agree to these Terms and our Privacy Policy.

1. Eligibility

• You must be at least 13 years old to use Antiquer, or meet your jurisdiction's minimum digital age of consent, whichever is higher.
• If you are under 18, your parent or legal guardian should review these Terms before you use the App.
• In EU member states where the digital age of consent exceeds 13 (e.g., 16 in Germany, Ireland, Netherlands, France), parental consent is required for users below that age to use the cloud AI scan feature.

2. Description of Service

Antiquer is an antique identification and appraisal application that uses artificial intelligence to identify objects from photos:

• Scan: Take or pick a photo of an antique, collectible, or vintage object. Antiquer returns an AI-generated identification including name, era, materials, condition, rarity, and an estimated valuation range in your selected currency.
• Archive: Save scans to a local collection ("the Archive") on your device. Browse, filter, sort, search, and revisit prior identifications offline.
• Curator chat: Ask follow-up questions about a scanned item ("Is this real?", "How should I store it?", "What's the price trend?") to a conversational AI persona.
• Certificate: Generate a printable Certificate of Appraisal as a one-page document for your records.
• Export: Download a complete JSON dump of your archive for portability or backup.

3. Subscriptions and Payments

3.1 Free Tier

The free tier lets you browse the App, view sample identifications, and read educational articles. Unlimited cloud scanning requires Antiquer Pro.

3.2 Antiquer Pro Subscription

Antiquer Pro unlocks unlimited AI scans, unlimited curator chat, exportable certificates, and priority processing:

• Annual: $34.99 per year — with a 3-day free trial for new users.
• Weekly: $4.99 per week — billed weekly.

Prices may vary by region and are displayed in your local currency at the time of purchase. The actual pricing shown in the App is authoritative. The displayed currency for AI valuation results can be changed at any time in Settings → Preferences → Currency — this is independent of your subscription billing currency, which is set by Apple based on your App Store region.

3.3 Free Trial Terms

• The Annual free trial is offered once per Apple ID per product.
• You will not be charged during the 3-day free trial period.
• Unless you cancel at least 24 hours before the trial ends, your subscription automatically converts to a paid Annual subscription at the displayed price.
• Cancelling during the trial gives you free access until the trial period ends.

• Cancellation takes effect at the end of the current billing period
• No partial refunds for unused time
• Refund requests: contact Apple through reportaproblem.apple.com

3.6 EU Right of Withdrawal

EU/EEA consumers have a 14-day right of withdrawal for digital content purchases under the Consumer Rights Directive (2011/83/EU). By confirming your subscription purchase in the App Store, you acknowledge that digital content delivery begins immediately and you consent to waive the 14-day withdrawal period as permitted under Article 16(m). You may still cancel auto-renewal for future periods at any time.

4. AI-Generated Content and Valuations

4.1 Nature of Content

• Identifications, valuations, era estimates, rarity scores, and historical context produced by Antiquer are generated by AI models and may contain inaccuracies, factual errors, or outdated information.
• Valuation ranges are not professional appraisals. They are AI-generated estimates based on patterns the model has learned, with grounding from publicly-listed comparable items via Google Search at the time of the scan.
• AI outputs are not a substitute for in-person inspection, hands-on authentication, scientific dating, or licensed expert appraisal. For decisions involving significant monetary value, insurance, customs declarations, estate planning, or legal proceedings, consult a qualified human appraiser, dealer, or auction-house specialist.
• We do not guarantee the accuracy, completeness, or suitability of any AI-generated identification or valuation for any particular purpose.

4.2 Content Ownership

• You retain full ownership of photos you scan and of the identification results stored in your local archive.
• You may use AI-generated identifications and certificates for personal purposes (insurance documentation, estate inventory, collection management). For commercial purposes (resale listings, professional appraisals, customs documentation), please verify all details with a qualified expert.
• We retain a limited, non-exclusive, royalty-free licence to process your photos solely for the purpose of providing the identification service (i.e., transmitting the photo to Google Gemini to perform the identification request). This licence terminates as soon as the identification is complete.
• We do not use your photos to train AI models. Google Vertex AI / Gemini does not use your photos to train its models per the enterprise API data-usage terms.

4.3 Cached Identifications

To keep prices stable across repeat scans of the same object (and to reduce cost), Antiquer caches AI identification results for 7 days using a SHA-256 hash of the image bytes plus your selected currency and locale. The original photo is not extractable from the cache key. Cache entries automatically expire after 7 days.

5. Acceptable Use

You agree not to use Antiquer to:

• Submit content that is unlawful, harmful to children, or otherwise prohibited under applicable law.
• Misrepresent AI-generated identifications as professional appraisals when reselling, insuring, or transferring items.
• Forge, alter, or fraudulently use the Certificate of Appraisal feature to misrepresent an item's authenticity, era, or value.
• Submit photos of items you do not have the legal right to identify or trade (e.g., stolen goods, items subject to cultural-heritage repatriation laws, ivory or other CITES-restricted materials in jurisdictions where their trade is prohibited).
• Reverse-engineer, decompile, or extract proprietary models, system prompts, or credentials from the App.
• Circumvent rate limits, authentication, or security measures.
• Use automated tools, scripts, or bots to submit requests to our servers.
• Resell, sublicense, or redistribute the App or its AI capabilities as a separate service.
• Use the App in violation of export-control laws, sanctions, or embargoes.

Violation of these rules may result in immediate termination of your access and, where applicable, referral to law enforcement.

6. Cultural-Heritage and Restricted Items

Antiquer is a software tool. Identifying an item via the App does not authorise its trade. Many countries restrict or prohibit the buying, selling, or export of:

• Items of cultural patrimony (subject to national heritage laws and UNESCO 1970 Convention)
• Ivory, rhinoceros horn, tortoiseshell, certain coral, and other CITES-listed materials
• Pre-Columbian, Egyptian, classical Greek/Roman, and other archaeological items without proper provenance documentation
• Native American, Aboriginal, and Indigenous artefacts under repatriation laws (e.g., NAGPRA in the United States)
• Nazi-era artefacts and objects with looted-art provenance

It is your responsibility to ensure that any identification, sale, purchase, export, or import of identified items complies with all applicable laws in your jurisdiction and any relevant transit jurisdictions.

7. Privacy

Our Privacy Policy describes data collection, use, and protection in detail, including the Apple Guideline 5.1.2(i) disclosure of all third-party AI providers. By using Antiquer, you agree to the Privacy Policy. The first time you tap "Scan", an in-app AI Consent screen names Google Gemini and Cloudflare and describes the data flow; you may decline at that point. You may also wipe all data and reset the AI Consent flag at any time via Settings → Data & Privacy → Delete All Data.

8. Intellectual Property

• The Antiquer application, design, code, branding, hand-drawn illustrations, fonts (Fraunces, Inter, JetBrainsMono — used under SIL Open Font Licence), and assembled AI pipeline are the intellectual property of Anton.
• "Antiquer" is a trademark of Anton.
• You may not copy, modify, distribute, or create derivative works from the App itself.
• Google Vertex AI and Gemini are services of Google LLC, used under their respective enterprise API terms. RevenueCat is a service of RevenueCat, Inc.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED IDENTIFICATIONS OR VALUATIONS WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR PURPOSE. WE MAKE NO WARRANTIES REGARDING THIRD-PARTY AI PROVIDERS, THEIR AVAILABILITY, OR THE QUALITY OF THEIR OUTPUTS. AI-GENERATED VALUATIONS DO NOT CONSTITUTE A PROFESSIONAL APPRAISAL.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANTON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST DATA, LOST PROFITS, LOST OPPORTUNITY, MISIDENTIFIED ITEMS, INCORRECT VALUATIONS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON ITS AI-GENERATED OUTPUTS. TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Anton from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party right, including privacy, publicity, intellectual property, or cultural-heritage rights; or (d) any content you submit through the App.

12. Termination

• You may stop using Antiquer at any time by deleting the App from your device.
• We may suspend or terminate your access for violations of these Terms, without notice.
• Local data remains on your device until you delete the App or use Settings → "Delete All Data".
• Active subscriptions continue until cancelled through the App Store. Refer to Section 3.5 for cancellation procedures.

13. Governing Law

These Terms are governed by the laws of Georgia (country). Disputes shall be resolved through good-faith negotiation, then through courts of competent jurisdiction.

EU/EEA residents: Nothing in these Terms deprives you of mandatory consumer protections under the laws of your country of residence, including those under EU Directive 2011/83/EU (Consumer Rights) and Directive 93/13/EEC (Unfair Contract Terms). Any dispute may also be brought before the courts of your country of residence.

14. Changes to These Terms

Material changes will be communicated via an updated "Last updated" date and, where practicable, an in-app notification. If the data flow changes (e.g., a new third-party AI provider is added), the AI Consent flag will be reset so users see the updated disclosure before their next scan. Continued use after changes constitutes acceptance.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.

16. Entire Agreement

These Terms, the Privacy Policy, and Apple's Standard Licensed Application End User Licence Agreement constitute the entire agreement between you and Anton regarding the use of Antiquer.
